1. About mybirdID

mybirdID is an online registry service for companion birds, operated by mybirdID Ltd, a company registered in England and Wales (registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom) (“we”, “us” or “mybirdID”).

The Service allows bird owners to record their birds' identifiers (leg rings, microchips, CITES/Article 10 certificates and photos), report birds as lost, and helps finders of stray birds identify potential owners through our Lost & Found feature.

Important notice: mybirdID is a voluntary registry. It is not an official government database, an authorised microchip registration service, or a licensed CITES authority. It does not replace statutory obligations to register microchips with an approved database, or to hold CITES documentation as required by law.

2. Accepting These Terms

By creating an account or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 18 years old to create an account. By registering, you confirm that you meet this requirement.

If you are using the Service on behalf of a business or organisation, you confirm that you have authority to bind that entity to these Terms.

3. Your Account

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must notify us immediately at help@mybirdid.com if you suspect unauthorised access.

You must provide accurate and up-to-date information when registering and when using the Service. We may suspend or close accounts where information is found to be false or misleading.

4. Using the Service

You may use the Service to:

  • Register your birds and record their physical identifiers, dates, and photographs;
  • Report a bird as lost and publish a public lost-bird listing;
  • Report a found bird and use our matching tools to identify a potential owner;
  • Be found by others through our Lost & Found matching system (subject to your privacy settings).

You may not use the Service to:

  • Upload content that infringes any third party's intellectual property rights;
  • Upload false, misleading, or fraudulent information about a bird or its ownership;
  • Harass, contact, or attempt to defraud other users;
  • Scrape, crawl, or systematically extract data from the Service;
  • Attempt to circumvent any security or access-control measures;
  • Use the Service for any unlawful purpose, including facilitating the illegal trade in protected species.

5. Plans and Payments

mybirdID offers two plans:

  • Free: allows you to register one bird. Information entered at registration cannot subsequently be edited or updated under the free plan.
  • Flock: a yearly subscription at £9.99 per year, billed annually, granting access to the full platform including unlimited bird registrations, full record editing, and all current and future features for as long as your subscription remains active.

The Flock plan is a recurring annual subscription. Your subscription will renew automatically each year unless cancelled before the renewal date. Payment is processed by Stripe, Inc., a third-party payment processor. Your payment details are held by Stripe and are not stored by mybirdID.

You may cancel your Flock subscription at any time. Access continues until the end of the current billing period. We will notify you of any price changes at least 30 days in advance.

All prices are inclusive of any applicable taxes unless otherwise stated. Where VAT or other taxes apply based on your location, they will be shown at checkout.

Refunds are not provided for partial billing periods, except where required by applicable law (including the Consumer Rights Act 2015 for UK consumers, and applicable EU consumer protection law including the 14-day right of withdrawal where applicable).

6. Your Content

You retain ownership of any photographs, descriptions, and other content you upload to the Service (“Your Content”).

By uploading Your Content, you grant mybirdID a worldwide, non-exclusive, royalty-free licence to store, display, reproduce, and process Your Content solely for the purpose of providing and improving the Service.

You confirm that Your Content does not infringe any third party's rights and that you have the right to grant the above licence. You are solely responsible for Your Content.

We may remove any content that violates these Terms or that we reasonably consider harmful, offensive, or unlawful, without notice.

7. Lost and Found

When a bird is reported as lost, a public listing is created containing the species, physical description, and area. Sensitive identifiers (ring numbers, microchip numbers) are not shown publicly.

When a found bird report is submitted, mybirdID may automatically compare the reported identifiers against its registry to identify potential matches. Any such match is indicative only; we make no guarantee of its accuracy.

Contact details are shared with finders only where you have explicitly opted in through your account notification settings. We are not responsible for any communications that take place directly between users following a match.

mybirdID is a tool to assist reunions. We cannot guarantee that any lost bird will be found or returned.

8. Sensitive Identifiers and Official Records

mybirdID allows you to record sensitive identifiers including microchip numbers, leg ring numbers, and CITES/Article 10 certificate numbers. You are responsible for ensuring that these are entered accurately.

mybirdID does not verify the accuracy or legal status of any identifier entered by a user. Recording a microchip number or CITES certificate number on mybirdID does not constitute official registration with any government authority or approved database.

You must ensure that you comply with all applicable laws regarding the keeping, registration, and trade of birds, including CITES obligations and any national or regional wildlife legislation.

9. Disclaimers

The Service is provided “as is” and “as available” without warranty of any kind, express or implied, to the fullest extent permitted by law.

We do not warrant that the Service will be uninterrupted, error-free, or that any data stored will not be lost. We recommend keeping your own records of your birds' identifiers.

We are not responsible for the accuracy of any information entered by other users, including found bird reports, sighting reports, or contact details.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, mybirdID's total liability to you for any claim arising from or related to the Service is limited to the greater of: (a) the total subscription fees you paid to us in the 12 months preceding the claim; or (b) £50.

We are not liable for any indirect, incidental, special, or consequential loss, including loss of a bird, loss of data, loss of revenue, or loss of profits, even if we have been advised of the possibility of such loss.

If you are a consumer in the UK or EU, nothing in this clause affects your statutory rights.

11. Termination

You may close your account at any time by contacting us at help@mybirdID.com. On closure, your bird records and personal data will be deleted in accordance with our Privacy Policy.

We may suspend or terminate your account if you breach these Terms, if we are required to do so by law, or if your account has been inactive for an extended period (with prior notice where possible).

On termination, provisions that by their nature should survive (including Sections 9, 10, and 13) will continue to apply.

12. International Use

The Service is available to users worldwide. These Terms are governed by English law, but if you are a consumer resident in the EU or EEA, you retain the benefit of any mandatory protections provided by the law of your country of residence.

If you access the Service from outside the United Kingdom, you are responsible for compliance with local laws applicable to your use of the Service, including any laws relating to the keeping or identification of birds.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer in the EU, you may also bring proceedings in the courts of your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. We will give you at least 14 days' notice of material changes by email or by displaying a notice on the Service. The updated Terms will take effect on the date stated in the notice.

Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service and close your account.
